1. Introduction
These Terms and Conditions govern the use of Short Message Service (SMS) communication services provided by ELITE CLEAN SERVICES LLC (hereinafter referred to as "Provider") to the recipient (hereinafter referred to as "Client").
ELITE CLEAN SERVICES LLC provides professional cleaning services in Utah. SMS messages may include appointment reminders, booking confirmations, promotional offers, and service updates.
2. Eligibility and Age Restriction
The SMS Service is intended for individuals who are 18 years of age or older. By opting into the Service, the Client represents and warrants that they are at least 18 years old and have the legal capacity to enter into this Agreement. The Provider does not knowingly collect information from or send SMS messages to individuals under the age of 18. If we become aware that we have collected information from a minor, we will promptly delete such information and discontinue communications.
3. Client Consent
By agreeing to these terms and conditions, the Client provides explicit consent to receive SMS messages from ELITE CLEAN SERVICES LLC confirmations, service updates, alerts, and promotional messages. The Client acknowledges that these messages may be of a transactional, informational, or promotional nature.
4. Frequency of Messages
You will receive up to 10 messages per month for service notifications, appointment reminders, and updates. For marketing and promotional messages, frequency varies up to 6 messages per month. Message and data rates may apply. Contact your wireless provider for details.
5. Opt-Out Mechanism
The Client has the right to opt-out of receiving SMS messages at any time. To unsubscribe, the Client can reply "STOP" to any message. After sending STOP, you will receive one final confirmation message and no further SMS messages will be sent. To re-subscribe, sign up again as you did the first time.
6. Data Usage and Privacy
The Provider respects the Client's privacy and will handle personal information in accordance with its Privacy Policy. By agreeing to these terms, the Client consents to the collection and use of their data as described.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
7. Costs and Charges
Standard messaging rates from the Client's mobile carrier may apply. The Provider is not responsible for any charges incurred. As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
8. Carrier Liability Disclaimer
Mobile carriers (including AT&T, T-Mobile, Verizon, Sprint, and others) are not liable for delayed or undelivered messages. The Provider is not responsible for technical issues, delivery failures, or delays beyond its control. Messages are delivered on an "as-is" and "as-available" basis without guarantees.
9. Service Availability
The Provider will make reasonable efforts to ensure service availability but is not liable for interruptions beyond its control.
10. Termination
The Provider reserves the right to suspend or terminate the SMS Service at any time without prior notice.
11. Changes to Terms and Conditions
The Provider may update these terms at any time. Clients are responsible for reviewing updates periodically.
By providing consent to receive SMS messages, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
